Note on data transfers to the USA and other third countries

Among other things, we use tools from companies based in the USA or in other third countries that are not secure under data protection law. When these tools are active, your personal data may be transferred to these third countries and processed there. Please note that a level of data protection comparable to that in the EU cannot be guaranteed in these countries. For example, US companies are obliged to hand over personal data to security authorities without you as the data subject being able to take legal action against this. It can therefore not be ruled out that US authorities (e.g. intelligence services) process, analyse and permanently store your data located on US servers for surveillance purposes. We have no influence on these processing activities.

Withdrawal of your consent to data processing

Many data processing operations are only possible with your express consent. You can withdraw consent you have already given at any time. The lawfulness of the data processing carried out until the withdrawal remains unaffected by the withdrawal.

Right to object to data collection in special cases and to direct marketing (Art. 21 GDPR)

If the data processing is based on Art. 6(1)(e) or (f) GDPR, you have the right at any time to object to the processing of your personal data on grounds relating to your particular situation; this also applies to profiling based on these provisions. The respective legal basis on which processing is based can be found in this privacy policy.

If you object, we will no longer process your personal data concerned unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims (objection pursuant to Art. 21(1) GDPR).

If your personal data is processed for the purpose of direct marketing, you have the right to object at any time to the processing of personal data concerning you for the purpose of such marketing; this also applies to profiling to the extent that it is related to such direct marketing. If you object, your personal data will subsequently no longer be used for the purpose of direct marketing (objection pursuant to Art. 21(2) GDPR).

Right to lodge a complaint with the competent supervisory authority

In the event of infringements of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, their place of work or the place of the alleged infringement. The right to lodge a complaint is without prejudice to any other administrative or judicial remedies.

Right to data portability

You have the right to have data that we process automatically on the basis of your consent or in fulfilment of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done to the extent that it is technically feasible.

Access, erasure and rectification

Within the scope of the applicable statutory provisions, you have the right at any time to information free of charge about your stored personal data, its origin and recipients and the purpose of the data processing and, where applicable, a right to rectification or erasure of this data. You can contact us at any time regarding this and any other questions on the subject of personal data.

Right to restriction of processing

You have the right to request the restriction of the processing of your personal data. You can contact us at any time for this purpose. The right to restriction of processing exists in the following cases:

  • If you contest the accuracy of your personal data stored by us, we usually need time to verify this. For the duration of the verification, you have the right to request the restriction of the processing of your personal data.
  • If the processing of your personal data was/is unlawful, you can request the restriction of data processing instead of erasure.
  • If we no longer need your personal data but you need it for the exercise, defence or establishment of legal claims, you have the right to request the restriction of the processing of your personal data instead of erasure.
  • If you have lodged an objection pursuant to Art. 21(1) GDPR, your interests and ours must be weighed against each other. As long as it has not yet been determined whose interests prevail, you have the right to request the restriction of the processing of your personal data.

If you have restricted the processing of your personal data, this data may – apart from its storage – only be processed with your consent or for the establishment, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the European Union or of a Member State.

SSL or TLS encryption

For security reasons and to protect the transmission of confidential content, such as orders or enquiries that you send to us as the site operator, this site uses SSL or TLS encryption. You can recognise an encrypted connection by the fact that the address line of the browser changes from “http://” to “https://” and by the lock symbol in your browser line.

If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

3. Data collection on this website

Cookies

Our websites use so-called “cookies”. Cookies are small data packages and do not cause any damage to your device. They are stored on your device either temporarily for the duration of a session (session cookies) or permanently (permanent cookies). Session cookies are automatically deleted at the end of your visit. Permanent cookies remain stored on your device until you delete them yourself or they are automatically deleted by your web browser.

Cookies can originate from us (first-party cookies) or from third-party companies (so-called third-party cookies). Third-party cookies enable the integration of certain services of third-party companies within websites (e.g. cookies for processing payment services).

Cookies have various functions. Many cookies are technically necessary, as certain website functions would not work without them (e.g. the shopping cart function or the display of videos). Other cookies may be used to evaluate user behaviour or for advertising purposes.

Cookies that are required to carry out the electronic communication process, to provide certain functions you have requested (e.g. for the shopping cart function) or to optimise the website (e.g. cookies for measuring the web audience) (necessary cookies) are stored on the basis of Art. 6(1)(f) GDPR, unless another legal basis is stated. The website operator has a legitimate interest in storing necessary cookies for the technically error-free and optimised provision of its services. If consent to the storage of cookies and similar recognition technologies has been requested, the processing is carried out exclusively on the basis of this consent (Art. 6(1)(a) GDPR and Section 25(1) TDDDG); consent can be withdrawn at any time.

You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or in general, and activate the automatic deletion of cookies when closing the browser. If cookies are deactivated, the functionality of this website may be limited.

You can find out which cookies and services are used on this website in this privacy policy.

Language selection and language cookie

The website is available in German, English and French. If you access the start address without specifying a language, the server redirects you to a language version. To do this, it evaluates the language set in your browser, which your browser sends with every request.

So that we can recognise the language you last used, the server sets the cookie lang when you access a language page:

PropertyValue
Namelang
Contentonly the language code de, fr or en
Duration1 year
Providerthis website only, no disclosure to third parties

The cookie does not contain any identifier with which we could identify you or recognise you across websites. It is technically necessary to provide the language you have selected. The legal basis for storing it on your device is Section 25(2) No. 2 TDDDG; for any processing of personal data, it is Art. 6(1)(f) GDPR. Our legitimate interest is a user-friendly language selection. You can delete the cookie in your browser at any time; the language setting of your browser will then be used again.

Consent with Klaro

For services that may only be used with your consent, we use the open-source tool Klaro. It is loaded from our own server; no data is transferred to third parties in the process.

Klaro stores your selection in a cookie named klaro in your browser so that we do not have to ask you again on your next visit. It is stored for 180 days. The legal basis is Art. 6(1)(c) GDPR in conjunction with Art. 7(1) GDPR, as we are required to demonstrate your consent, and Section 25(2) No. 2 TDDDG.

You can withdraw or change your consent at any time with effect for the future via the “Cookie settings” link at the bottom of every page. The lawfulness of the processing carried out until the withdrawal remains unaffected.

Server log files

The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:

  • Browser type and browser version
  • Operating system used
  • Referrer URL
  • Host name of the accessing computer
  • Time of the server request
  • IP address

This data is not merged with other data sources.

This data is collected on the basis of Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the technically error-free presentation and the optimisation of its website – for this purpose, the server log files must be collected.

Contact form

We integrate a contact form on the contact page. It is loaded from our Mautic server, which we operate ourselves. When the form is loaded, your IP address is transmitted to this server. The form itself does not set a cookie when it is loaded.

When you submit the form, we process the data you have entered: title, first name, surname, business activity, company, city, e-mail address, phone number and your message. We use it to answer your enquiry and to conduct further communication with you. The data is stored on our Mautic server and is not passed on to third parties.

The legal basis is Art. 6(1)(b) GDPR if your enquiry is related to a contract or serves to carry out pre-contractual measures, otherwise Art. 6(1)(f) GDPR. Our legitimate interest lies in processing your enquiry. The legal basis for loading the form is Art. 6(1)(f) GDPR; our legitimate interest is to provide a means of contact.

We delete the data as soon as it is no longer required for processing your enquiry and the follow-up communication, unless statutory retention periods prevent this.

Enquiries by e-mail, telephone or fax

If you contact us by e-mail, telephone or fax, your enquiry, including all resulting personal data (name, enquiry), will be stored and processed by us for the purpose of handling your request. We do not pass on this data without your consent.

This data is processed on the basis of Art. 6(1)(b) GDPR if your enquiry is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective handling of enquiries addressed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR) if this has been requested; consent can be withdrawn at any time.

The data you send to us via contact enquiries remains with us until you ask us to delete it, withdraw your consent to storage or the purpose for the data storage no longer applies (e.g. after your request has been processed). Mandatory statutory provisions – in particular statutory retention periods – remain unaffected.

Calendly

On our website, you have the option of making appointments with us. We use Calendly for booking appointments. The provider is Calendly, Inc., 115 E Main St., Ste A1B, Buford, GA 30518, USA (hereinafter “Calendly”).

For the purpose of booking an appointment, you enter the requested data and the desired date in the form provided for this purpose. The data entered is used for planning, conducting and, where applicable, following up on the appointment. Calendly also records log files (number and time of page views, browser, browser version and operating system as well as an anonymised IP address).

The appointment data is stored for us on Calendly’s servers; you can view Calendly’s privacy policy here: https://calendly.com/legal/privacy-notice (opens in new tab).

The data you enter remains with us until you ask us to delete it, withdraw your consent to storage or the purpose for the data storage no longer applies. Mandatory statutory provisions – in particular retention periods – remain unaffected.

The legal basis for the data processing is Art. 6(1)(f) GDPR. The website operator has a legitimate interest in arranging appointments with prospective customers and customers as easily as possible. If corresponding consent has been requested, the processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR and Section 25(1) TDDDG, insofar as the consent includes the storage of cookies or access to information on the user’s device (e.g. device fingerprinting) within the meaning of the TDDDG. Consent can be withdrawn at any time.

Data processing

We have concluded a data processing agreement (DPA) for the use of the above-mentioned service. This is a contract required by data protection law which ensures that the processor processes the personal data of our website visitors only in accordance with our instructions and in compliance with the GDPR.

Registration on this website

You can register on this website in order to use additional functions on the site. We use the data entered for this purpose only for the purpose of using the respective offer or service for which you have registered. The mandatory information requested during registration must be provided in full. Otherwise, we will reject the registration.

In the event of important changes, for example to the scope of the offer or in the case of technically necessary changes, we will use the e-mail address provided during registration to inform you in this way.

The data entered during registration is processed for the purpose of implementing the user relationship established by the registration and, where applicable, for initiating further contracts (Art. 6(1)(b) GDPR).

The data collected during registration is stored by us for as long as you are registered on this website and is subsequently deleted. Statutory retention periods remain unaffected.

4. Social media

Meta Platforms: Facebook and Instagram

Facebook

Elements of the social network Facebook are integrated on this website. The provider of this service is Meta Platforms Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Ireland. However, according to Facebook, the data collected is also transferred to the USA and to other third countries.

An overview of the Facebook social media elements can be found here: https://developers.facebook.com/docs/plugins/?locale=de_DE (opens in new tab).

When the social media element is active, a direct connection is established between your device and the Facebook server. If you are logged into your Facebook account, Facebook can assign the visit to this website to your user account. Please note that we, as the provider of these pages, have no knowledge of the content of the transmitted data or its use by Facebook. Further information on this can be found in Meta’s privacy policy at: https://www.facebook.com/privacy/policy/ (opens in new tab).

According to this agreement, we are responsible for providing the data protection information when using the Facebook tool and for the data protection-compliant implementation of the tool on our website. Facebook is responsible for the data security of the Facebook products. You can assert data subject rights (e.g. requests for access) regarding the data processed by Facebook directly with Facebook. If you assert the data subject rights with us, we are obliged to forward them to Facebook.

Data may be transferred to the USA. Meta Platforms, Inc. is certified under the EU-U.S. Data Privacy Framework; the transfer is therefore based on an adequacy decision of the European Commission (Art. 45 GDPR). Instagram determines which data it processes and for how long; details can be found in Instagram’s privacy policy: https://privacycenter.instagram.com/policy/ (opens in new tab).

The legal basis is your consent (Art. 6(1)(a) GDPR, Section 25(1) TDDDG). You can withdraw it at any time with effect for the future via our Cookie settings.

We and Meta are joint controllers for the collection of the data on our website and its forwarding to Meta (Art. 26 GDPR). Meta is solely responsible for the subsequent processing. The wording of the agreement can be found at: https://www.facebook.com/legal/controller_addendum (opens in new tab). X

Functions of the X service (formerly Twitter) are integrated on this website (e.g. embedded posts or share buttons) in order to display content from X to you and to enable you to share our content. The provider is X Internet Unlimited Company (formerly Twitter International Unlimited Company), One Cumberland Place, Fenian Street, Dublin 2, D02 AX07, Ireland (“X”).

LinkedIn

5. Analysis tools and advertising

Google Tag Manager and Google Analytics

With your consent, we use Google Tag Manager and Google Analytics 4. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. You can choose the two services separately in the consent dialog. Without your consent, they are not loaded and no data is transmitted to Google.

Google Tag Manager

Google Tag Manager is a tool that allows us to integrate and manage other services on the website. Google Analytics 4 is currently loaded via it. Tag Manager itself does not create user profiles or analyse anything. However, when it is loaded, your IP address is transmitted to Google, and a transfer to Google LLC in the USA is possible.

Google Analytics 4

Google Analytics measures how the website is used, for example which pages are viewed, how long visitors stay, where they come from and which device they use. For this we use a separate property for each language version, so the data of the German, English and French pages is recorded separately. The data is used to improve the website. It is stored for 14 months.

Google Analytics sets the following cookies:

PropertyValue
Name_ga and _ga_ followed by the identifier of the property
Contentrandom identifier to recognise you on later visits, session data
Duration2 years
ProviderGoogle Ireland Limited

We use Google Analytics without advertising features. For this we use Google Consent Mode in its basic variant: when it is loaded, the website only tells Google that you have agreed to analytics. The signals for advertising purposes (ad_storage, ad_user_data, ad_personalization) are always set to “denied”.

Google LLC is certified under the EU-US Data Privacy Framework. Transfers to the USA are therefore covered by an adequacy decision of the European Commission pursuant to Art. 45 GDPR.

The legal basis is your consent pursuant to Art. 6(1)(a) GDPR and Section 25(1) TDDDG. Without your consent, Google Tag Manager and Google Analytics are not loaded. You can withdraw your consent at any time via “Cookie settings” at the bottom of every page. Further information: https://policies.google.com/privacy (opens in new tab).

Hotjar

This website uses Hotjar. The provider is Hotjar Ltd., Level 2, St Julians Business Centre, 3, Elia Zammit Street, St Julians STJ 1000, Malta, Europe (website: https://www.hotjar.com (opens in new tab)).

Hotjar is a tool for analysing your user behaviour on this website. With Hotjar, we can, among other things, record your mouse and scroll movements and clicks. Hotjar can also determine how long you have kept the mouse pointer on a particular spot. From this information, Hotjar creates so-called heatmaps, which can be used to determine which areas of the website are preferably viewed by website visitors.

Furthermore, we can determine how long you stayed on a page and when you left it. We can also determine at which point you abandoned your entries in a contact form (so-called conversion funnels).

In addition, Hotjar can be used to obtain direct feedback from website visitors. This function serves to improve the website operator’s web offerings.

Hotjar uses technologies that enable the recognition of the user for the purpose of analysing user behaviour (e.g. cookies or the use of device fingerprinting).

If consent has been obtained, the above-mentioned service is used exclusively on the basis of Art. 6(1)(a) GDPR and Section 25 TDDDG. Consent can be withdrawn at any time. If no consent has been obtained, this service is used on the basis of Art. 6(1)(f) GDPR; the website operator has a legitimate interest in analysing user behaviour in order to optimise both its website and its advertising.

Deactivating Hotjar

If you would like to deactivate data collection by Hotjar, click on the following link and follow the instructions there: https://www.hotjar.com/policies/do-not-track/ (opens in new tab)

Please note that Hotjar must be deactivated separately for each browser or each device.

Further information about Hotjar and the data collected can be found in Hotjar’s privacy policy at the following link: https://www.hotjar.com/privacy (opens in new tab)

Data processing

We have concluded a data processing agreement (DPA) for the use of the above-mentioned service. This is a contract required by data protection law which ensures that the processor processes the personal data of our website visitors only in accordance with our instructions and in compliance with the GDPR.

Clarity

This website uses Clarity. The provider is Microsoft Ireland Operations Limited, One Microsoft Place, South County Business Park, Leopardstown, Dublin 18, Ireland, https://docs.microsoft.com/en-us/clarity/ (opens in new tab) (hereinafter “Clarity”).

Clarity is a tool for analysing user behaviour on this website. In particular, Clarity records mouse movements and creates a graphical representation of the parts of the website to which users scroll particularly frequently (heatmaps). Clarity can also record sessions so that we can view the use of the site in the form of videos. We also receive information about general user behaviour within our website.

Clarity uses technologies that enable the recognition of the user for the purpose of analysing user behaviour (e.g. cookies or the use of device fingerprinting). Your personal data is stored on Microsoft servers (Microsoft Azure Cloud Service) in the USA.

If consent has been obtained, the above-mentioned service is used exclusively on the basis of Art. 6(1)(a) GDPR and Section 25 TDDDG. Consent can be withdrawn at any time. If no consent has been obtained, this service is used on the basis of Art. 6(1)(f) GDPR; the website operator has a legitimate interest in effective user analysis.

Further details on data protection at Clarity can be found here: https://docs.microsoft.com/en-us/clarity/faq (opens in new tab).

Data processing

We have concluded a data processing agreement (DPA) for the use of the above-mentioned service. This is a contract required by data protection law which ensures that the processor processes the personal data of our website visitors only in accordance with our instructions and in compliance with the GDPR.

The contact form, which is also provided via Mautic, is described in the section “Contact form” in section 3. The data is not transferred to the manufacturer or any other third party.

We use Mautic to evaluate how our website is used and to manage our marketing activities on this basis. For this purpose, you receive an individual identifier when you visit, which is stored in cookies and recognises you on later visits: mautic_device_id (device identifier, duration 1 year), mtc_id (identifier as a contact, 1 year), mautic_referer_id (attribution of the page view, 1 year), mtc_sid (session identifier, 1 year) and mautic_session_id (session identifier, 1 year). In addition, Mautic stores mtc_id and mautic_device_id in your browser’s local storage; these entries remain until you delete them in your browser. Your IP address, the language setting of your browser, the pages accessed and the time of access are recorded in the process.

The legal basis is your consent pursuant to Art. 6(1)(a) GDPR and Section 25(1) TDDDG. Without your consent, Mautic is not loaded. You can withdraw your consent at any time with effect for the future via our Cookie settings. The data is deleted as soon as it is no longer required for the purpose or you withdraw your consent and inform us of this.

Google Ads

The website operator uses Google Ads. Google Ads is an online advertising program of Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Ads enables us to display advertisements in the Google search engine or on third-party websites when the user enters certain search terms on Google (keyword targeting). Furthermore, targeted advertisements can be displayed on the basis of the user data available to Google (e.g. location data and interests) (target group targeting). As the website operator, we can evaluate this data quantitatively, for example by analysing which search terms led to the display of our advertisements and how many advertisements led to corresponding clicks.

This service is used on the basis of your consent pursuant to Art. 6(1)(a) GDPR and Section 25(1) TDDDG. Consent can be withdrawn at any time.

The data transfer to the USA is based on the standard contractual clauses of the European Commission. Details can be found here: https://policies.google.com/privacy/frameworks (opens in new tab) and https://privacy.google.com/businesses/controllerterms/mccs/ (opens in new tab).

Google AdSense (non-personalised)

This website uses Google AdSense, a service for integrating advertisements. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

We use Google AdSense in “non-personalised” mode. Unlike in personalised mode, the advertisements are therefore not based on your previous user behaviour and no user profile is created about you. Instead, so-called “contextual information” is used to select the advertising. The selected advertisements are then based, for example, on your location, the content of the website you are on or your current search terms. More information on the differences between personalised and non-personalised targeting with Google AdSense can be found at: https://support.google.com/adsense/answer/9007336 (opens in new tab).

Please note that even when Google AdSense is used in non-personalised mode, cookies or comparable recognition technologies (e.g. device fingerprinting) may be used. According to Google, these are used to combat fraud and abuse.

This service is used on the basis of your consent pursuant to Art. 6(1)(a) GDPR and Section 25(1) TDDDG. Consent can be withdrawn at any time.

The data transfer to the USA is based on the standard contractual clauses of the European Commission. Details can be found here: https://privacy.google.com/businesses/controllerterms/mccs/ (opens in new tab).

You can adjust your advertising settings yourself in your user account. To do so, click on the following link and log in: https://adssettings.google.com/authenticated (opens in new tab).

Further information on Google’s advertising technologies can be found here: https://policies.google.com/technologies/ads (opens in new tab) and https://www.google.de/intl/de/policies/privacy/ (opens in new tab).

Google Ads Remarketing

This website uses the functions of Google Ads Remarketing. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

With Google Ads Remarketing, we can assign people who interact with our online offering to certain target groups in order to subsequently display interest-based advertising to them in the Google advertising network (remarketing or retargeting).

Furthermore, the advertising target groups created with Google Ads Remarketing can be linked to Google’s cross-device functions. In this way, interest-based, personalised advertising messages that have been adapted to you depending on your previous usage and browsing behaviour on one device (e.g. mobile phone) can also be displayed on another of your devices (e.g. tablet or PC).

If you have a Google account, you can object to personalised advertising via the following link: https://www.google.com/settings/ads/onweb/ (opens in new tab).

This service is used on the basis of your consent pursuant to Art. 6(1)(a) GDPR and Section 25(1) TDDDG. Consent can be withdrawn at any time.

Further information and the data protection provisions can be found in Google’s privacy policy at: https://policies.google.com/technologies/ads?hl=de (opens in new tab).

Building target groups with customer matching

To build target groups, we use, among other things, the customer matching feature of Google Ads Remarketing. In doing so, we pass certain customer data (e.g. e-mail addresses) from our customer lists to Google. If the customers concerned are Google users and are logged into their Google account, suitable advertising messages are displayed to them within the Google network (e.g. on YouTube, Gmail or in the search engine).

Google DoubleClick

This website uses functions of Google DoubleClick. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland (hereinafter “DoubleClick”).

DoubleClick is used to display interest-based advertisements to you throughout the Google advertising network. With the help of DoubleClick, advertisements can be tailored to the interests of the respective viewer. For example, our advertising can be displayed in Google search results or in advertising banners linked to DoubleClick.

In order to be able to display advertising tailored to users’ interests, DoubleClick must be able to recognise the respective viewer and assign to them the web pages they have visited, clicks and other information on user behaviour. For this purpose, DoubleClick uses cookies or comparable recognition technologies (e.g. device fingerprinting). The information collected is combined into a pseudonymous user profile in order to display interest-based advertising to the user concerned.

This service is used on the basis of your consent pursuant to Art. 6(1)(a) GDPR and Section 25(1) TDDDG. Consent can be withdrawn at any time.

Further information on the options for objecting to the advertisements displayed by Google can be found at the following links: https://policies.google.com/technologies/ads (opens in new tab) and https://adssettings.google.com/authenticated (opens in new tab).

Meta Pixel (formerly Facebook Pixel)

To measure conversions, this website uses the visitor action pixel from Facebook/Meta. The provider of this service is Meta Platforms Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland. However, according to Facebook, the data collected is also transferred to the USA and to other third countries.

This allows the behaviour of site visitors to be tracked after they have been redirected to the provider’s website by clicking on a Facebook advertisement. This enables the effectiveness of Facebook advertisements to be evaluated for statistical and market research purposes and future advertising measures to be optimised.

The data collected is anonymous for us as the operator of this website; we cannot draw any conclusions about the identity of the users. However, the data is stored and processed by Facebook, so that a connection to the respective user profile is possible and Facebook can use the data for its own advertising purposes in accordance with the Facebook Data Use Policy (https://de-de.facebook.com/about/privacy/ (opens in new tab)). This enables Facebook to place advertisements on Facebook pages as well as outside of Facebook. We as the site operator cannot influence this use of the data.

This service is used on the basis of your consent pursuant to Art. 6(1)(a) GDPR and Section 25(1) TDDDG. Consent can be withdrawn at any time.

Insofar as personal data is collected on our website with the help of the tool described here and forwarded to Facebook, we and Meta Platforms Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland are joint controllers for this data processing (Art. 26 GDPR). The joint responsibility is limited exclusively to the collection of the data and its forwarding to Facebook. The processing by Facebook that takes place after the forwarding is not part of the joint responsibility. The obligations incumbent on us jointly have been set out in a joint processing agreement. The wording of the agreement can be found at: https://www.facebook.com/legal/controller_addendum (opens in new tab).

The data transfer to the USA is based on the standard contractual clauses of the European Commission. Details can be found here: https://www.facebook.com/legal/EU_data_transfer_addendum (opens in new tab) and https://de-de.facebook.com/help/566994660333381 (opens in new tab).

Further information on protecting your privacy can be found in Facebook’s privacy notices: https://de-de.facebook.com/about/privacy/ (opens in new tab).

You can also deactivate the remarketing function “Custom Audiences” in the advertising settings section at https://www.facebook.com/ads/preferences/?entry_product=ad_settings_screen (opens in new tab). To do this, you must be logged into Facebook.

If you do not have a Facebook account, you can deactivate usage-based advertising by Facebook on the website of the European Interactive Digital Advertising Alliance: http://www.youronlinechoices.com/de/praferenzmanagement/ (opens in new tab).

LinkedIn Insight Tag

This website uses the Insight Tag from LinkedIn. The provider of this service is LinkedIn Ireland Unlimited Company, Wilton Plaza, Wilton Place, Dublin 2, Ireland.

Data processing by LinkedIn Insight Tag

With the help of the LinkedIn Insight Tag, we receive information about the visitors to our website. If a website visitor is registered with LinkedIn, we can, among other things, analyse the key professional data (e.g. career level, company size, country, location, industry and job title) of our website visitors and thus better align our site with the respective target groups. Furthermore, we can use LinkedIn Insight Tags to measure whether visitors to our websites make a purchase or carry out another action (conversion measurement). Conversion measurement can also be carried out across devices (e.g. from PC to tablet). LinkedIn Insight Tag also offers a retargeting function with the help of which we can display targeted advertising to visitors to our website outside the website, whereby, according to LinkedIn, the recipient of the advertising is not identified.

LinkedIn itself also collects so-called log files (URL, referrer URL, IP address, device and browser characteristics and time of access). The IP addresses are shortened or (if they are used to reach LinkedIn members across devices) hashed (pseudonymised). The direct identifiers of LinkedIn members are deleted by LinkedIn after seven days. The remaining pseudonymised data is then deleted within 180 days.

The data collected by LinkedIn cannot be assigned to specific individuals by us as the website operator. LinkedIn will store the collected personal data of website visitors on its servers in the USA and use it for its own advertising measures. For details, please refer to LinkedIn’s privacy policy at https://www.linkedin.com/legal/privacy-policy#choices-oblig (opens in new tab).

Legal basis

If consent has been obtained, the above-mentioned service is used exclusively on the basis of Art. 6(1)(a) GDPR and Section 25 TDDDG. Consent can be withdrawn at any time. If no consent has been obtained, this service is used on the basis of Art. 6(1)(f) GDPR; the website operator has a legitimate interest in effective advertising measures, including social media.

The data transfer to the USA is based on the standard contractual clauses of the European Commission. Details can be found here: https://www.linkedin.com/legal/l/dpa (opens in new tab) and https://www.linkedin.com/legal/l/eu-sccs (opens in new tab).

Objection to the use of LinkedIn Insight Tag

You can object to the analysis of usage behaviour and to targeted advertising by LinkedIn via the following link: https://www.linkedin.com/psettings/guest-controls/retargeting-opt-out (opens in new tab).

Furthermore, LinkedIn members can control the use of their personal data for advertising purposes in their account settings. To prevent LinkedIn from linking data collected on our website with your LinkedIn account, you must log out of your LinkedIn account before visiting our website.

Data processing

We have concluded a data processing agreement (DPA) for the use of the above-mentioned service. This is a contract required by data protection law which ensures that the processor processes the personal data of our website visitors only in accordance with our instructions and in compliance with the GDPR.

Leadinfo

We analyse visits by companies to our website with the help of an external service provider.

For this purpose, we use the service of Leadinfo B.V., Rivium Quadrant 141, 2909 LC Capelle aan den IJssel, Netherlands, https://www.leadinfo.com (opens in new tab). Leadinfo matches the IP addresses of our website visitors with publicly available company data and shows us which companies have visited our website (e.g. company name and address). In addition, Leadinfo sets two cookies (_li_id and _li_ses, duration up to two years) to evaluate which pages are accessed and whether a visit is repeated. Leadinfo processes this data on our behalf (Art. 28 GDPR). Leadinfo is itself the controller for building its company database; details can be found in Leadinfo’s privacy policy: https://www.leadinfo.com/de/rechtliches/datenschutz/ (opens in new tab).

The categories of data subjects are website visitors, in particular visitors who access our website via a company’s network.

The purpose of the processing is the recognition of company visits for lead generation.

The legal basis is your consent (Art. 6(1)(a) GDPR, Section 25(1) TDDDG). Leadinfo is only loaded once you have given your consent in our cookie banner. You can withdraw your consent at any time with effect for the future via our Cookie settings.

Irrespective of this, you can object to collection by Leadinfo here: https://www.leadinfo.com/en/legal/opt-out/ (opens in new tab). In the event of an opt-out, your data will no longer be collected by Leadinfo.

6. Newsletter

Newsletter data

If you would like to receive the newsletter offered on the website, we require an e-mail address from you as well as information that allows us to verify that you are the owner of the e-mail address provided and that you agree to receive the newsletter. Further data is not collected or is only collected on a voluntary basis. We use this data exclusively for sending the requested information and do not pass it on to third parties.

The data entered in the newsletter registration form is processed exclusively on the basis of your consent (Art. 6(1)(a) GDPR). You can withdraw the consent you have given to the storage of the data and the e-mail address and their use for sending the newsletter at any time, for example via the “unsubscribe” link in the newsletter. The lawfulness of the data processing operations already carried out remains unaffected by the withdrawal.

The data you have provided to us for the purpose of receiving the newsletter will be stored by us or the newsletter service provider until you unsubscribe from the newsletter and will be deleted from the newsletter distribution list after you cancel the newsletter or when the purpose no longer applies. We reserve the right to delete or block e-mail addresses from our newsletter distribution list at our own discretion within the scope of our legitimate interest pursuant to Art. 6(1)(f) GDPR.

Data that has been stored by us for other purposes remains unaffected by this.

After you have unsubscribed from the newsletter distribution list, your e-mail address may be stored by us or the newsletter service provider in a blacklist, if this is necessary to prevent future mailings. The data from the blacklist is only used for this purpose and is not merged with other data. This serves both your interest and our interest in complying with the legal requirements when sending newsletters (legitimate interest within the meaning of Art. 6(1)(f) GDPR). Storage in the blacklist is not limited in time. You can object to the storage if your interests outweigh our legitimate interest.

Google Maps

This site uses the map service Google Maps. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

To use the functions of Google Maps, it is necessary to store your IP address. This information is usually transferred to a Google server in the USA and stored there. The provider of this site has no influence on this data transfer. If Google Maps is activated, Google may use Google Fonts for the purpose of uniform display of fonts. When you access Google Maps, your browser loads the required web fonts into its browser cache in order to display texts and fonts correctly.

reCAPTCHA is only loaded when you click “Accept” in the form. Before that, no data is transmitted to Google. After your consent, reCAPTCHA checks whether the entry was made by a human. For this purpose, your IP address, information about your browser and device, the time spent on the page and your interactions with the page, among other things, are transmitted to Google. Google may set cookies for this purpose. A transfer to Google LLC in the USA is possible. Google LLC is certified under the EU-US Data Privacy Framework, so the adequacy decision pursuant to Art. 45 GDPR applies.

The legal basis is your consent pursuant to Art. 6(1)(a) GDPR and Section 25(1) TDDDG. Without consent, the form cannot be submitted. In that case, you can reach us by e-mail or telephone, see section 2, “Information on the controller”. The consent applies to the current page view and can be ended by reloading the page.

Data processing

We have concluded a data processing agreement (DPA) for the use of the above-mentioned service. This is a contract required by data protection law which ensures that the processor processes the personal data of our website visitors only in accordance with our instructions and in compliance with the GDPR.

Potential calculator

We provide an interactive potential calculator on our website. Users can enter various company-related key figures (e.g. number of applications per year, profiles already placed, average revenue per profile). An estimated revenue potential is calculated on the basis of these entries.

As a rule, the calculation is carried out locally in the user’s browser. For this purpose, the values entered are stored together with a timestamp in the browser’s local storage (localStorage). This data is not automatically transmitted to our servers.

Storage in localStorage serves exclusively the technical functionality of the calculator and makes it possible to display the calculated result within the session.

If users subsequently actively book an appointment or initiate contact via the calculator, the previously entered values are transmitted to our servers together with the contact details provided, in preparation for the consultation.

This data is processed only if users actively click on “Book appointment”, and thus for the purposes of processing the request, preparing consultations and internal sales and customer support.

The legal basis for the processing is Art. 6(1)(b) GDPR (implementation of pre-contractual measures at the request of the data subject) and Art. 6(1)(f) GDPR (legitimate interest in the efficient handling of enquiries and the preparation of consultations).

The appointment and customer data is stored for us on Calendly’s servers; you can view Calendly’s privacy policy here: https://calendly.com/legal/privacy-notice.

The data you enter remains with us until you ask us to delete it, withdraw your consent to storage or the purpose for the data storage no longer applies. Mandatory statutory provisions – in particular retention periods – remain unaffected.

8. E-commerce and payment providers

Processing of customer and contract data

We collect, process and use personal customer and contract data for the establishment, content arrangement and modification of our contractual relationships. We collect, process and use personal data on the use of this website (usage data) only insofar as this is necessary to enable the user to use the service or to bill for it. The legal basis for this is Art. 6(1)(b) GDPR.

The customer data collected is deleted after completion of the order or termination of the business relationship and expiry of any existing statutory retention periods. Statutory retention periods remain unaffected.

9. Audio and video conferences

Data processing

Among other things, we use online conference tools to communicate with our customers. The tools we use in detail are listed below. If you communicate with us by video or audio conference via the internet, your personal data is collected and processed by us and by the provider of the respective conference tool.

The conference tools collect all data that you provide/use in order to use the tools (e-mail address and/or your telephone number). Furthermore, the conference tools process the duration of the conference, the start and end (time) of participation in the conference, the number of participants and other “context information” in connection with the communication process (metadata).

Furthermore, the provider of the tool processes all technical data required to handle the online communication. This includes, in particular, IP addresses, MAC addresses, device IDs, device type, operating system type and version, client version, camera type, microphone or loudspeaker and the type of connection.

If content is exchanged, uploaded or otherwise provided within the tool, it is also stored on the servers of the tool providers. Such content includes, in particular, cloud recordings, chat/instant messages, voicemails, uploaded photos and videos, files, whiteboards and other information shared while using the service.

Please note that we do not have full influence on the data processing operations of the tools used. Our options are largely determined by the corporate policy of the respective provider. Further information on data processing by the conference tools can be found in the privacy policies of the respective tools used, which we have listed below this text.

Purpose and legal bases

The conference tools are used to communicate with prospective or existing contractual partners or to offer certain services to our customers (Art. 6(1)(b) GDPR). Furthermore, the use of the tools serves the general simplification and acceleration of communication with us or our company (legitimate interest within the meaning of Art. 6(1)(f) GDPR). If consent has been requested, the tools in question are used on the basis of this consent; consent can be withdrawn at any time with effect for the future.

Storage period

The data collected directly by us via the video and conference tools is deleted from our systems as soon as you ask us to delete it, withdraw your consent to storage or the purpose for the data storage no longer applies. Stored cookies remain on your device until you delete them. Mandatory statutory retention periods remain unaffected.

We have no influence on the storage period of your data that is stored by the operators of the conference tools for their own purposes. For details, please contact the operators of the conference tools directly.

Personal data such as participant names, contact details and conversation content is processed.

In addition, we evaluate conversation content across conversations in aggregated form in order to better understand customer needs, to further develop our products and offerings and to improve the quality of our conversations. No individual customer profiles are created in the process. There is no automated decision-making within the meaning of Art. 22 GDPR, no emotion recognition and no creation of personality profiles.

The legal basis for the processing is our legitimate interest in efficient documentation and follow-up of our conversations and in improving our sales processes (Art. 6(1) sentence 1(f) GDPR). We inform you about the use of Bliro at the beginning of the conversation. At your request, we will deactivate the transcription immediately at any time; you can also object to the processing at any time (Art. 21 GDPR). Transcripts are stored in accordance with our retention policy and deleted as soon as they are no longer required; on request, they are deleted without undue delay. 10. Own services

Handling of applicant data

We offer you the opportunity to apply to us (e.g. by e-mail, by post or via an online application form). Below, we inform you about the scope, purpose and use of your personal data collected in the course of the application process. We assure you that the collection, processing and use of your data will be carried out in accordance with applicable data protection law and all other statutory provisions and that your data will be treated in strict confidence.

Scope and purpose of data collection

If you send us an application, we process your associated personal data (e.g. contact and communication data, application documents, notes taken during job interviews, etc.) insofar as this is necessary for deciding on the establishment of an employment relationship. The legal basis for this is Section 26 BDSG under German law (initiation of an employment relationship), Art. 6(1)(b) GDPR (general initiation of a contract) and – if you have given consent – Art. 6(1)(a) GDPR. Consent can be withdrawn at any time. Within our company, your personal data will only be passed on to persons involved in processing your application.

If the application is successful, the data you have submitted will be stored in our data processing systems on the basis of Section 26 BDSG and Art. 6(1)(b) GDPR for the purpose of implementing the employment relationship.

Retention period of the data

If we are unable to offer you a position, you reject a job offer or you withdraw your application, we reserve the right to retain the data you have submitted on the basis of our legitimate interests (Art. 6(1)(f) GDPR) for up to 6 months from the end of the application procedure (rejection or withdrawal of the application). The data will then be deleted and the physical application documents destroyed. The retention serves in particular as evidence in the event of a legal dispute. If it is apparent that the data will be required after the 6-month period has expired (e.g. due to an impending or pending legal dispute), it will only be deleted when the purpose for further retention no longer applies.

Longer retention may also take place if you have given corresponding consent (Art. 6(1)(a) GDPR) or if statutory retention obligations prevent deletion.

Inclusion in the applicant pool

If we do not make you a job offer, it may be possible to include you in our applicant pool. In the event of inclusion, all documents and information from the application are transferred to the applicant pool in order to contact you in the event of suitable vacancies.

Inclusion in the applicant pool takes place exclusively on the basis of your express consent (Art. 6(1)(a) GDPR). Giving consent is voluntary and has no bearing on the current application procedure. The data subject can withdraw their consent at any time. In this case, the data from the applicant pool will be irrevocably deleted, unless there are statutory reasons for retention.

The data from the applicant pool will be irrevocably deleted no later than two years after consent has been given.

11. Beta tests and data protection

In the context of our beta tests, we collect personal data exclusively for the purpose of further developing and improving our product. This data is processed on the basis of Art. 6(1)(f) GDPR (legitimate interest) or – if consent has been obtained – on the basis of Art. 6(1)(a) GDPR.

The data collected is used exclusively to evaluate user behaviour, to analyse errors and to optimise our product. It is not passed on to third parties unless this is necessary to fulfil the above-mentioned purposes or is required by law.

As soon as the purpose of the processing no longer applies – in particular upon completion of the beta test phase – the personal data will be deleted without undue delay, unless statutory retention obligations prevent this.

12. Our social media presences

This privacy policy applies to the following social media presences

Data processing by social networks

We maintain publicly accessible profiles on social networks. The social networks we use in detail can be found below.

Social networks such as Facebook, Twitter etc. can generally analyse your user behaviour comprehensively if you visit their website or a website with integrated social media content (e.g. like buttons or advertising banners). Visiting our social media presences triggers numerous processing operations relevant to data protection. In detail:

If you are logged into your social media account and visit our social media presence, the operator of the social media portal can assign this visit to your user account. However, your personal data may under certain circumstances also be collected if you are not logged in or do not have an account with the respective social media portal. In this case, this data is collected, for example, via cookies stored on your device or by recording your IP address.

With the help of the data collected in this way, the operators of the social media portals can create user profiles in which your preferences and interests are stored. In this way, interest-based advertising can be displayed to you inside and outside the respective social media presence. If you have an account with the respective social network, interest-based advertising can be displayed on all devices on which you are or were logged in.

Please also note that we cannot trace all processing operations on the social media portals. Depending on the provider, further processing operations may therefore be carried out by the operators of the social media portals. Details can be found in the terms of use and data protection provisions of the respective social media portals.

Legal basis

Our social media presences are intended to ensure the most comprehensive presence possible on the internet. This is a legitimate interest within the meaning of Art. 6(1)(f) GDPR. The analysis processes initiated by the social networks may be based on different legal bases, which are to be specified by the operators of the social networks (e.g. consent within the meaning of Art. 6(1)(a) GDPR).

Controller and assertion of rights

If you visit one of our social media presences (e.g. Facebook), we and the operator of the social media platform are joint controllers for the data processing operations triggered during this visit. You can in principle assert your rights (access, rectification, erasure, restriction of processing, data portability and complaint) both against us and against the operator of the respective social media portal (e.g. against Facebook).

Please note that, despite the joint responsibility with the social media portal operators, we do not have full influence on the data processing operations of the social media portals. Our options are largely determined by the corporate policy of the respective provider.

Storage period

The data collected directly by us via the social media presence is deleted from our systems as soon as you ask us to delete it, withdraw your consent to storage or the purpose for the data storage no longer applies. Stored cookies remain on your device until you delete them. Mandatory statutory provisions – in particular retention periods – remain unaffected.

We have no influence on the storage period of your data that is stored by the operators of the social networks for their own purposes. For details, please obtain information directly from the operators of the social networks (e.g. in their privacy policy, see below).

Your rights

You have the right at any time to receive information free of charge about the origin, recipient and purpose of your stored personal data. You also have the right to object, the right to data portability and the right to lodge a complaint with the competent supervisory authority. Furthermore, you can request the rectification, blocking, erasure and, under certain circumstances, the restriction of the processing of your personal data.
